Thank you for visiting (the “Site”), operated by the State Board of the Great Outdoors Colorado Trust Fund (“GOCO,” “we,” “us,” or “our”). This Privacy Policy (the “Policy”) describes the collection and use of information you provide us through the Site.

Information Collected About Visitors

We collect and retain two types of Information about Site visitors: (i) personal Information that individual visitors provide when interacting on the Site or voluntarily at certain other points (such as via forms, account registration, or emails), including, without limitation, when you ask a question, register for our newsletter or blog, or otherwise receive news and Information about GOCO programs and initiatives; and (ii) tracking data, which is automatically collected from every Site visitor (collectively, “Information”). The personal Information that we gather may include your name, address, company or organization name, user name, and email address. Also, if you contact us, we may keep a record of your correspondence, including any Information contained therein.

When you visit the Site, certain anonymous Information about your visit is automatically captured. This Information includes the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet, the date and time you access the Site, the pages that you access while at the Site, and the Internet address of the website from which you linked directly to our Site. None of this Information is personally identifiable. This Information is used to help improve the Site, analyze trends and visitors viewing the Site, as well as to administer the Site. We attempt to aggregate such tracking data so that no such data is tied to you in any personally identifiable manner; however, due to the nature of the Internet, this is not always feasible, and tracking data may be traceable back to you.

If you want to receive our newsletter and/or participate on our blog, you will be required to register on the Site and create a password. You are responsible for providing current, accurate, and complete Information during the registration process. In order to protect your Information, you are responsible for maintaining the security and confidentiality of your password together with your login ID/email address. Should we make a material change to the manner in which we use or share your Information, we will give you an opportunity to opt out of such new or different use.

Use of Your Information

We use your personal Information for the following purposes:

  • To register you to receive our newsletter and/or participate in our blog.
  • To respond to your requests or correspondence.

We use tracking data for a variety of purposes, including, without limitation, for load-balancing metrics, to create reports on user demographics and Site traffic patterns, and to help us diagnose problems with our server or other technical issues relating to the performance of the Site. Colorado Open Records Act

The Colorado Open Records Act presumes that most state records are disclosable to the public. “It is declared to be the public policy of this state that all public records shall be open for inspection by any person at reasonable times, except as provided in Part 2 or as otherwise specifically provided by law.” § 24-72-201, et seq., C.R.S. If personal Information is requested on the website or volunteered by the user, state and federal law may protect it. However, this Information is a public record once you provide it and may be subject to public inspection and copying if not protected by federal or state law. Users are cautioned that the collection of personal Information requested from or volunteered by children online or by email will be treated the same as Information given by an adult and may be subject to public access.

Third Parties

GOCO may hire third-party agents or third-party service providers to operate the Site and to perform functions on our behalf, including mailing and delivering materials, answering questions, analyzing data, other administrative tasks, and/or acting as an agent for third-party software, content, or services. These third parties have access to the Information needed to perform their functions. We seek to limit such third parties to using the Information that is shared with them solely for the purpose of providing such services; however, we cannot be responsible for such third parties’ use of Information not in compliance with this Policy. We use cookies on this Site to ensure the integrity of the registration process to receive our newsletter and/or participate in our blog. We use a session cookie that expires soon after you complete the registration process, and it is not stored on your hard drive.

GOCO does not knowingly direct Information to, or solicit Information from, people under 18 years of age. If you are a parent of a child under 18 who has used the Site, you may contact GOCO, and it will delete any Information about your child as soon as reasonably possible.

Applicable Law

This Policy is governed in all respects by the laws of the State of Colorado, without regard to conflicts-of-law provisions. You irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the state and federal courts located in Colorado for any litigation or dispute arising out of or relating to this Policy and agree that such courts represent the exclusive jurisdiction for all disputes relating to this Policy. If any part of this Policy is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of this Policy shall continue in force and effect.
